How Can NRIs Get Birth Certificate through NABC?

Those who travel overseas from India may want to register their child’s birth with Indian authority. These are the cases of those who want to return after retirement from abroad.

This piece of information can guide them on exactly how they can get it done. This process has a crucial role of the non-availability of birth certificate (or NABC). You would learn about it in this blog.

Registration of NRIs’ Unregistered Birth

Non-residents often want to register their ward’s birth with India. Section 20 of the Registration of Births and Death Act, 1969 provides a special provision for registering unregistered birth. They can be NRI children who are born outside the country.

Here, the crucial thing is Indian parentage. Any child born to Indian parents outside India can get the birth registered from the native place here at any time. It would be provided in respect of whom the information has not been received as given under the Citizenship Act, 1955.

In other words, this is a case of the non-availability of a birth certificate or NABC. The non-resident parents may at any time, but within 60 days from the day they arrive in India, can apply for this proof. This document procurement will help in getting the original birth certificate of that child under the aforesaid Act.

NABC to Help in Registering Even if 60 Days Passed

A newborn child of such parents can also apply for this proof. Section 13 of the same Act allows it. The non-resident parents can get it registered. However, they have to pay an extra amount as a penalty fee for late registration. 

As you apply, the Municipal Corporation would issue an NABC. The registrar may ask you to visit the District Collectorate. There, the competent authority equivalent to the position of Revenue Divisional Officer (RDO) will ask some questions to conduct a quick survey. 

Upon getting appropriate answers, the revenue official will redirect non-resident parents to the civic body. It will issue a birth certificate for the child born outside India.

However, the Indian embassy may also issue it, which would be acceptable and valid across the globe. Being a non-resident of India, you would have to present it to the civic body within 60 days of your arrival. This act will help it to register the birth of that child in India.

However, a big population of migrant Indians is not aware of this provision. So, it often hired NRI agents or pay brokers for registering the birth of their child. If not so, they themselves visit the Municipal Corporation office for the same purpose.

Steps to Get a Birth Certificate Offline

However, this process is applicable to those who want to get this job done themselves. But sometimes, emigrants face a struggle in getting through this process of getting an NABC.

Step 1: Visit the Municipal Corporation (in districts or cities) or Gram Panchayat (in villages) where you took birth. Withdraw an NABC from the authorities at a nominal charge.

Step 2: The RDO will issue a notice to the embassy to verify if it issued any birth proof before. Once satisfied that it was not registered before, you may re-visit the Registrar for birth proof.

Step 3: Provide the concerned registrar the proof of date of birth, place, and time. You may show some necessary documents like educational qualification certificates, address proof, NABC, and Aadhar Card.

Step 4: Afterward, he will verify the details, and then, you have to pay a nominal fee.

Checklist of Documents for Verification

These documents will help you to verify your application quickly.

  • Passport or visa
  • An affidavit if the birth document is missing
  • Proof of birth document provided by the hospital at the time of the birth anywhere
  • Birth proofs of parents and a self-attested copy of any one of your address proofs
  • Documentary proof of address, which can be a Voter ID Card, electricity or utility bills, passport, Aadhaar card, Ration card, and an active bank account

Steps to Get a Birth Certificate Online

As aforesaid, the concerned Municipal Corporation or civic authority in India issues a birth certificate. It is a must to get it registered with the concerned local authority. If you belong to any village, there is the Gram Panchayat office to issue it.

It will ask for proof to verify if the birth is already registered. The same procedure will be carried out as aforementioned.

Once you have the non-availability of a birth certificate, apply online this way. 

Step 1: Visit the Birth and Death Registration website. This link i.e. https://crsorgi.gov.in/web/index.php/auth/signUp can let you access the online place for registration.

Step 2: Once registered, download the application form, fill in the details, and forward it to the concerned registrar. Avoid sending through courier. You may visit there physically. The address of the Registrar’s office will be mentioned there at the bottom.

Step 3: As the application is received, you will receive an email on your registered email ID. Save it and refer to the reference number for checking the status of your application.  

Meanwhile, you have to pay the fee. Remember, any event of late birth registration or unregistered birth can be reported under the Delayed Registration provision of the Act. The authority will charge a late fee.

Step 4: Now that you have the Application Reference Number, type it on the website to check the status of your application.

Step 5: As the process is complete, the registrar will issue that birth proof, and you will receive it at your registered address.

Step 6: You will receive the certificate without the name if the child is a newborn, and you have applied within 21 days of his/ her birth. In that case, 12 months’ time duration will be there to add the name without any fee.

NRI should avoid middlemen who may ask to pay a whopping Rs 15,000 for each birth certificate. You may contact a verified NRI agent or solicitor for this purpose.
